29 CFR 1926.20(b)(2):  It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part; such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.  On July 11, 2019 at 1112 Oxford Ct in Neenah, the employer did not ensure that a competent person was performing frequent and regular inspections that could have recognized the potential fall from elevation hazards associated with employees using portable ladders to access/egress roof surfaces without side-rails extending three feet above the roof edge, using an extension ladder with tripping hazards at the base, and using an extension ladder positioned on a slippery surface.

29 CFR 1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side-rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grab-rail, shall be provided to assist employees in mounting and dismounting the ladder.  a)  On July 11, 2019 at 1112 Oxford Ct in Neenah, an employee was using an extension ladder to access/egress a roof surface eighteen feet above surface level without side-rails extending three feet above the roof edge.  b)  On July 11, 2019 at 1112 Oxford Ct in Neenah, employees were using a self-supporting ladder to access/egress a roof surface five feet above a lower roof surface without any grasping device above the upper roof edge.

29 CFR 1926.1053(b)(7): Ladders shall not be used on slippery surfaces unless secured or provided with slip-resistant feet to prevent accidental displacement. Slip-resistant feet shall not be used as a substitute for care in placing, lashing, or holding a ladder that is used upon slippery surfaces including, but not limited to, flat metal or concrete surfaces that are constructed so they cannot be prevented from becoming slippery.  On July 11, 2019 at 1112 Oxford Ct in Neenah, an employee was using an unsecured extension ladder to access/egress a roof surface with the ladder feet pads positioned on top of a tarp which was covering a grassy surface.

On July 11, 2019 at 1112 Oxford Ct in Neenah, the employer did not provide required fall protection safety training for employees who did not associate fall from elevation hazards when using a ladder on a roof surface to access an upper roof surface without side-rails extending three feet above the landing surface, using an extension ladder to access a roof surface without side-rails extending three feet above the roof edge, tripping hazards at the base and positioned on a slippery surface, and walking/working on roof surfaces with unprotected edges without utilizing fall protection equipment.
