OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to an employee that were being elevated by a rough terrain forklift. (a) Charleston: On or about July 12, 2019, an employee was adjusting the globe of a light post while elevated on a pallet set on the forks of a JCB (model 507-42) rough terrain forklift to a height of approximately 10 feet.
