29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: At Kansas City Pallets located at 1301 East 31st Street, Kansas City, MO, the employer failed to establish a Hearing Conservation Program. Employees were exposed to continuous noise levels higher than 85 dBA in the following areas: (a) Saw Operators: An employee was exposed to continuous noise level at 180.7% dose of the allowable 8-hour time-weighted average sound level of 85 dBA or an equivalent sound level of approximately 94 dBA. The sampling was performed for 469 minutes during one shift; exposure calculations included a zero increment for the 198 minutes not sampled. (b) Saw Operators: An employee was exposed to continuous noise level at 274.2% dose of the allowable 8-hour time-weighted average sound level of 85 dBA or an equivalent sound level of approximately 97.2 dBA. The sampling was performed for 453 minutes during one shift; exposure calculations included a zero increment for the 27 minutes not sampled. (c) Pallet Building: An employee was exposed to continuous noise level at 396.4% dose of the allowable 8-hour time-weighted average sound level of 85 dBA or an equivalent sound level of approximately 99.9 dBA. The sampling was performed for 451 minutes during one shift; exposure calculations included a zero increment for the 29 minutes not sampled. (d) Pallet Building: An employee was exposed to continuous noise level at 263.5% dose of the allowable 8-hour time-weighted average sound level of 85 dBA or an equivalent sound level of approximately 96.9 dBA. The sampling was performed for 444 minutes during one shift; exposure calculations included a zero increment for the 36 minutes not sampled.
