29 CFR 1926.453(b)(2)(v): A body belt with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift:  (a) New townhome construction located on Lot #69, Roof: On or about 07/18/2019, and at times prior, the employer exposed employees to ejection/fall hazards of approximately 42-feet to the lower ground level, in that a personal fall arrest system was not provided or used while transporting shingles to the roof in the aerial lift basket.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:  (a) New townhome construction located on Lot #69, Roof: On or about 07/18/2019, and at times prior, the employer exposed employees to fall hazards of approximately 42-feet to the lower ground level, in that a fall protection system was not provided to employees engaged in roofing activities on a 3/12 pitched roof.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  (a) New townhome construction located on Lot #69, Front side: On or about 07/18/2019, and at times prior, the employer exposed employees to fall hazards of approximately 30-feet to the lower ground level, in that the ladder used to access the upper and lower levels was not extended at least 3-feet past the eave to allow for safe access on and of the roof.
