29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: A) Juan Maya Samano, doing business as Juan Construction, conducting work at 412 Melick Drive, Delaware, OH 43015: On or about July 23, 2019, the employer did not ensure that employees were adequately trained in the appropriate use of fall protection such as, but not limited to, the use of personal fall arrest systems, or alternative measures of fall protection while conducting roofing activities atop the one story residential structure. Employees were exposed to approximately 10 feet fall hazard from the roof of the structure to the ground below.

29 CFR 1926.20(b)(1): The employer did not initiate and maintain programs necessary to ensure compliance with the Occupational Safety and Health Standards: A) Juan Maya Samano, doing business as Juan Construction, conducting work at 412 Melick Drive, Delaware, OH 43015: On or about July 23, 2019, the employer did not have a plan or program to identify job site hazards which assists employees in maintaining a safe working environment. Such programs would support the employer and employees in identifying and avoiding potential hazards such as, but not limited to, falls during job site operations. Juan Maya Samano, doing business as Juan Construction was previously cited for a violation of this Occupational Safety and Health Standard (1926.20(b)(1)), which was contained in OSHA Inspection # 1324481, Citation number 1, Item number 1, and was affirmed as a final order on July 30, 2018, with respect to a workplace located at 5742 Knob Creek Drive, Westerville, OH 43081.
