On or about January 21, 2021, the employer did not ensure employees utilized eye protection while operating a pneumatic nail gun to install anchor points on the roof of a new-build apartment building. As a result, employees were exposed to struck-by hazards and resulting eye injuries.

29 CFR 1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part. a. On or about January 21, 2021, the employer failed to initiate and maintain programs to prevent accidents and injuries to employees while performing roofing work and associated activities. As a result, employees were exposed to falls from height, struck-by, and struck-against hazards associated with the roofing work being performed. Juan Maya Samano was previously cited for a Repeat-Serious violation of this Occupational Safety and Health Standard, which was contained in OSHA inspection number 1418877, citation number 2, item number 1A and was affirmed as a final order on December 17, 2019, with respect to a workplace located at 412 Melick Drive, Delaware, Ohio, 43015. Juan Maya Samano was previously cited for a Serious violation of this Occupational Safety and Health Standard, which was contained in OSHA inspection number 1324481, citation number 1, item number 1 and was affirmed as a final order on July 30, 2018, with respect to a workplace located at 5742 Knob Creek Drive, Westerville, Ohio, 43081.

The employer did not ensure that struck-by hazards and the potential eye injury exposures were eliminated.
