29 CFR 1926.20(b)(2): At this job site, the employer had not made frequent and regular inspections of the job sites, materials , and equipment to be made by competent persons designated by the employers:    JOB SITE: 247 Brougham Drive, Dardenne Prairie, MO 63368, on or about 7/30/2019, sub-contractor employees were working on the roof of a residential structure. The general contractor and the subcontractor were on the job site providing material for the project.  Neither the General Contractor nor the subcontractor conduct an adequate inspection of the job site.  Employees were exposed to the following:    1.  Employees were not utilizing guardrail systems, a safety net system, or personal fall arrest systems.  The employee were observed on top of a 6:12 pitch roof, approximately 9' 3"above the ground level without fall protection.  The employees were exposed to a fall hazard.   2.  Employees were observed using a Werner Aluminum extension ladder, for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed.  The employees were exposed to a fall hazard.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:    JOB SITE: 247 Brougham Drive, Dardenne Prairie, MO 63368, on or about 7/30/2019, workers were observed using a Werner Aluminum extension ladder, MODEL: MT-17, 18 FT Reach Height, 300LB Capacity, for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed.  The workers were exposed to a fall hazard.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):     JOB SITE: 247 Brougham Drive, Dardenne Prairie, MO 63368, on or about 7/30/2019, workers were observed top of a 6:12 pitch roof, approximately 9 feet 3 inches eave to ground level, actively tearing off roofing materials and were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measures. The workers were exposed to a fall hazard.    Cesar Arango was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1254178, citation number 1, item number 1 and issued on 8/16/2017 was affirmed as a final order on 10/31/2017, with respect to a workplace located at 415 Sandra Way, Winfield, MO 63389.
