29 CFR 1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section: a) 300 Block D Street, NW - An employee was operating a 90 lbs. jack hammer to break up a concrete sidewalk without it being equipped with either a water delivery system or a commercially available shroud and dust collection system, on or about 07/31/2019. b) 300 Block D Street, NW - An employee used a Stihl chop saw, model number TS420 to make cuts in the concrete sidewalk while a employee applied water from a 5 gallon bucket instead of using an integrated water delivery system or a commercially available shroud and dust collection system, on or about 07/31/2019. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet).
