29 CFR 1910.1200(e)(1): Employer had not developed or implemented a written hazard communication program which at included the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii):   Phase 3 Area: Employees were preparing footings for the structural foundation. Employees were using Aervoe survey marking paint, which is a skin irritant and suspected carcinogen, without a written hazard communication program implemented and maintained at the worksite. Employees were exposed to irritation and/or health hazards.

29 CFR 1910.1200(g)(8):   The employer did not maintain in the workplace copies of the required safety data sheets for each hazardous chemical, and did not ensure that they were readily accessible during each work  shift to employees when they were in their work area(s):  Phase 3 Area: Employees were preparing footings for the structural foundation. Employees were using Aervoe survey marking paint, which is a skin irritant and suspected carcinogen, without a safety data sheet maintained at the worksite. Employees were exposed to irritation and/or health hazards.

The rotor hammer and Ridgid battery charger were powered by daisy-chained flexible cords and a relocatable power tap. Employees were exposed to electrical shock and/or burn hazards.

29 CFR 1926.405(g)(2)(iv): Flexible cords were not connected to devices and fittings so that strain relief is provided to prevent pull from being directly transmitted to joints or terminal screws:  Phase 3 Area: Employees were digging footings and chiseling dirt. A flexible cord, which provided power to the rotor hammer, was identified with its plug pulled away from the jacket and wiring, exposing internal insulation and components. Employees were exposed to electrical shock hazards.
