29 CFR 1910.147(c)(1): Energy control program. The employer shall establish a program consisting of energy control procedures, employee training and periodic inspections to ensure that before any employee performs any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative.      On or about July 17, 2019, and at times prior thereto, the employer did not develop a written lockout/tagout program that incorporated procedures for each machine, employee training, and periodic inspections describing how to lockout and control hazardous energy sources for affected and authorized employees.  Employees operated machines, such as but not limited to the Mustang MTL20 skid steer, serial number 21404072, etc. which exposed employees to the hazard of being caught in or struck by the equipment.

29 CFR 1910.147(c)(4)(ii): Procedures did not clearly and specifically outline the scope, purpose, authorization, rules, and techniques to be utilized for the control of hazardous energy, and the means to enforce compliance including, but not limited to, 29 CFR 1910.147(c)(4)(ii)(A), (c)(4)(ii)(B), (c)(4)(ii)(C) and (c)(4)(ii)(D):      On or about July 17, 2019, and at times prior thereto, the employer did not ensure that procedures were developed that clearly and specifically identified the equipment and its energy sources and the techniques to be utilized for each piece of equipment for the control of all hazardous energy sources.  Employees engaged in service and/or maintenance activities were exposed to being caught-in, struck-by and electrical shock hazards.

29 CFR 1910.147(c)(5)(ii)(C)(1): Lockout devices were not substantial enough to prevent removal without the use of excessive force or unusual techniques, such as with the use of bolt cutters or other metal cutting tools:    On or about July 17, 2019, the employer did not ensure that employees who performed maintenance and/or service work on machinery, such as the Mustang MLT20 Skid Steer, serial number 21404072, utilized appropriate locking devices that were substantial enough to prevent removal during the maintenance activities.  Employees were exposed to struck-by and crush-by hazards.

29 CFR 1910.147(d)(4)(ii): Lockout devices utilized were not affixed in a manner that held the energy isolating device in a safe or off position:   On or about July 17, 2019, the employer did not ensure that employees who performed maintenance and/or service work on machinery such as the Mustang MLT20 Skid Steer, serial number 21404072, utilized appropriate locking devices and affixed the locking devices in a safe manner to isolate the energy source.  Employees were exposed to struck-by and crush-by hazards. The manufacturer's lockout device was not utilized or engaged at the time of the incident.
