29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): On or about August 12, 2019, the employer failed to ensure the operator of the Skytrak telehandler, model 10054, was trained. The operator was lifting employees in a personnel work platform. Employees exposed to a fall hazard.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1m) above a lower level was not protected from falling to that lower level by fall protection established in accordance with paragraphs (g)(1)(i) through (vii) of this section: On or about August 12, 2019, the employer failed to ensure employees were not standing and working from the mid rail of the personnel work platform. The work platform was attached to a Skytrak telehandler and elevated so employees could install stucco. Employees exposed to a fall hazard of approximately 16 feet to the ground below.
