29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval:  On or about August 12, 2019, the employer failed to ensure they had prior approval from the manufacture that the Skytrak telehandler model 10054 could safely lift the employees in the personnel work platform. Employees exposed to a fall hazard of approximately 16 feet to the ground below.

29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  On or about August 12, 2019, the employer failed to ensure the operator of the Skytrak telehandler, model 10054, was trained. The operator was lifting employees in a personnel work platform. Employees exposed to a fall hazard.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1m) above a lower level was not protected from falling to that lower level by fall protection established in accordance with paragraphs (g)(1)(i) through (vii) of this section:  On or about August 12, 2019, the employer failed to ensure employees were not standing and working from the mid rail of the personnel work platform. The work platform was attached to a Skytrak telehandler and elevated so employees could install stucco. Employees exposed to a fall hazard of approximately 16 feet to the ground below.

29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards:  On or about August 12, 2019, the employer failed to ensure employees working from a personnel work platform were trained. Employees were standing on the mid rails of the baskets with no fall protection. Employees exposed to a fall hazard of approximately 16 feet to the lower level.
