29 CFR 1926.451(a)(6): Scaffolds were not designed by a qualified person and were not constructed and loaded in accordance with that design: On or about November 18, 2019, and at times prior thereto, the employer failed to ensure that the personnel work platform attached to rough terrain trucks Model G12-55A and 10054, which was used to lift personnel with materials to upper floors and for applying stucco on the side of the building, had the following: basket width not exceeding the wheel base width more than 10 inches (basket width exceeded wheel base by > 50 inches), design and safety factor for loads, designated anchorage point, tare weight and rated capacity and attachment point. Employees were exposed to a fall hazard of approximately 36 feet to ground below.

29 CFR 1926.602(c)(1)(vi): Industrial truck(s) in use did not meet the applicable requirements of design, construction, stability, inspection, testing, maintenance, and operation, as defined in American National Standards Institute B56.1-1969, Safety Standards for Powered Industrial Trucks. On or about November 18, 2019, and at times prior thereto, employer failed to ensure that rough terrain trucks model G12-55A and 10054 meet the applicable requirements in the ANSI B56.1-1969, by having the following: basket width not exceeding the wheel base width more than 10 inches (basket width exceeded wheel base by > 50 inches), design and safety factor for loads, designated anchorage point, tare weight and rated capacity and attachment point. Employees were exposed to a fall hazard of approximately 36 feet to ground below.

29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): On or about November 18 2019, and at times prior thereto, the employer failed to ensure the operator of the rough terrain forklifts, Model G12-55A and Model 10054, was trained. The operator was lifting employees and materials in a unapproved personnel work platform attached to the forklift, exposing employees to the hazard being struck by a forklift or load. The Pesados Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.178 (l)(1)(i) which was contained in OSHA inspection number 1422457, citation number 1, item number 2 and was affirmed as a final order on October 03, 2019, with respect to a workplace located at 625 Commercial Loop, San Marcos, TX 78666.
