OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazards where: Location: Exelon Medway Station On or about August 13, 2109, an employee was injured by flying debris caused by the unanticipated release of pressurized nitrogen from a pressurized 3963 Gallon ELBI of America, Inc. Bladder Tank, Part #Custom-4484 where training on the manufacturers bladder replacement instructions had not been provided.

29 CFR 1910.147(d)(6): Prior to starting work on machines or equipment that had been locked out or tagged out, the authorized employee did not verify that isolation and deenergization of the machine or equipment had been accomplished. Location: Worksite On or about August 13, 2019, employees were exposed to hazardous energy in the form of pressurized nitrogen while working on a glycol expansion tank where the employer had not acknowledged the presents of hazardous energy in the vessel.
