29 CFR 1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation:  (a) New townhome construction located on Lots #20-25, Third level: On or about 08/28/2019, and at times prior, the employer exposed employees to struck-by hazards while operating pneumatic framing nail guns, in that protective eyewear was not provided to employees engaged in framing activities operating these tools at 110 PSI.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:   (a) New townhome construction located on Lots #20-25, Third level: On or about 08/28/2019, and at times prior, the employer exposed employees to fall hazards of 21-feet, 6-inches to the lower level, in that a fall protection system was not provided to employees engaged in framing activities.

29 CFR 1926.1053(b)(4): Ladder(s) were used for purposes other than the purpose for which they were designed.  (a) New townhome construction located on Lots #20-25, Lot #22 front side: On or about 08/28/2019, and at times prior, the employer exposed employees to fall hazards of approximately 4-feet, 9-inches to the ground level, in that A-frame ladders were used as straight ladders and employees were using the top cap and top step as a work surface to install plywood sheathing on the first level of the structure.

29 CFR 1926.403(b)(1): Employer did not ensure that electrical equipment is free from recognized hazards that are likely to cause death or serious physical harm to employees:  (a) New townhome construction located on Lots #20-25, Front side and temporary service box: On or about 08/28/2019, and at times prior, the employer failed to inspect all of the electrical cords prior to start of the work shift. Multiple cords used to power tools had damaged strain relief and torn casings. The employer failed to inspect and repair or remove these cords from service prior to the start of the shift.
