29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee is fit tested or required to use the respirator in the workplace: (a) On and before 8/30/2019, in the chicken coop area, for the staff wearing a 3M half face respirator while sterilizing supplies by dipping or spraying with Virkon S containing hazardous chemicals such as, but not limited to, malic acid and an N95 respirator required when dusting the coop. The employees were not provided a medical evaluation prior to being required to wear the respirator.

29 CFR 1910.151(c): Where employees were exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body were not provided within the work area for immediate emergency use: (a) On and before 8/30/2019, in the egg wash room, for the packing/shipping employees using BioSentry BioQuat 20 disinfectant that is corrosive containing chemicals such as, but not limited to, quaternary ammonia, ethanol, and sodium carbonate. The employer did not provide an eyewash and shower station.

29 CFR 1910.134(f)(2): The employer did not ensure that employees using tight fitting face piece respirators pass an appropriate qualitative or quantitative fit test prior to initial use of the respirator, whenever a different respirator facepiece (size, style, model or make) is used, and at least annually thereafter: (a) On and before 8/30/2019, in the chicken coop area, for the staff wearing a 3M half face respirator while sterilizing supplies by dipping or spraying with Virkon S containing hazardous chemicals such as, but not limited to, malic acid and an N95 respirator required when dusting the coop. The employees were not fit tested, either qualitatively or quantitatively, prior to being required to use this respirator by the employer.
