29 CFR 1926.1053(b)(1): When portable ladders were used for access to an upper landing surface, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension was not possible because of the ladder's length, then the ladder was not secured at its top to a rigid support that will not deflect, and a grasping device, such as a grab rail, was not provided to assist employees in mounting and dismounting the ladder.  a)  Brandenberger Roofing, LLC on or about August 8, 2019, at the address of 310 W First St., Defiance, OH: The employer did not ensure the side rails of the 30 feet aluminum extension ladder was extended at least three feet above the landing surface. Six employees were exposed to falls of up to 24 ft. while using the ladder to access the west side of the second level and the steep-sloped roof.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels is not protected by guardrail systems, safety net system, or personal fall arrest system nor are employees provided with an alternative fall protection measure under another provision of paragraph 1926.501(b):  a)     Brandenberger Roofing, LLC on or about August 8, 2019, at the address of 310 W First St., Defiance, OH: The employer did not ensure employees were protected from falls while installing new roofing materials (Asphalt shingles) to a residential type structure.  Employees were exposed to a potential 24 foot falls to the level below while performing roofing activities on  the residential structure second level roof.               Brandenberger Roofing was previously cited for a violation of this Occupational Safety and Health standard 1926.501(b)(13) which was contained in OSHA inspection number 1394102, citation number 1, item number 1 and was affirmed as a final order on June 06, 2019, with respect to a workplace located at 5 Winfield Manor Court Lot#2, Perrysburg, OH.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards.  A) Brandenberger Roofing L.L.C. on or about August 8, 2019 at the address of 310 W First St., Defiance, OH: The employer had not trained employees in the appropriate use of fall protection, such as but not limited to, the use of personal fall arrest systems while performing various roofing operations. The employees did not recognize the hazards associated with working from an elevated location (24 feet) without the benefit of fall protection.     Brandenberger Roofing, LLC was previously cited for a violation of this Occupational Safety and Health standard 1926.503(a)(1) which was contained in OSHA inspection number 1394102, citation number 1, item number 1 and affirmed as final order on June 06, 2019, with respect to a workplace located at 5 Winfield Manor Court Lot#2, Perrysburg, OH.
