OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(l) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm, including severe burns, to employees in that employees were exposed to dust explosion, deflagration, or other fire hazards from dust collectors being located inside a building: Ricoh Electronics, Inc., Lawrenceville, GA - The company had a Donaldson Torit dust collector system located in the thermal coating department, second floor, that collected combustible dust from the mixers, on or about 9/4/19.

29 CFR 1910.1200(f)(6): Workplace labeling. Except as provided in paragraphs (f)(7) and (f)(8) of this section, the employer shall ensure that each container of hazardous chemicals in the workplace is labeled, tagged or marked with either: (i) The information specified under paragraphs (f)(1)(i) through (v) of this section for labels on shipped containers; or, (ii) Product identifier and words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals, and which, in conjunction with the other information immediately available to employees under the hazard communication program, will provide employees with the specific information regarding the physical and health hazards of the hazardous chemical. Ricoh Electronics, Inc., Lawrenceville, GA - In the thermal coating department, the employer did not ensure that each bag of hazardous chemicals in the workplace, such as but not limited to, BPS-44, BPS-24 and 2,4-Dihydroxydiphenyl sulfone, was labeled, tagged or marked as required, on or about 9/4/19.
