29 CFR 1910.178(l)(4)(iii): An evaluation of each powered industrial truck operator's performance was not conducted at least once every 3 years. On or about 05 September 2019, and at times prior thereto, one employee was operating an JLG Rough Terrain Telehandler forklift (Model# 6042 T4F) with no refresher performance evaluation in the last 3 years, exposing employees to the hazard of being struck by a forklift or load.

29 CFR 1926.701(b): All protruding reinforcing steel, onto and into which employees could fall, was not guarded to eliminate the hazard of impalement. On or about 05 September 2019, and at times prior thereto, employees worked around a manhole where vertical rebar was installed. The 1/2 inch rebar was ~37.5 inches tall and not capped, creating a hazard of being impaled by the rebar.
