29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): On or about September 9, 2019, at a worksite located at the corner of Howe Road and Main Street, Cuyahoga Falls, OH 44221, during commercial construction activities the employer did not ensure the operator of the rough terrain forklift, Gehl Admar 300831, was competent and trained. The operator left the fork lift unattended with the load engaging means raised.
