29 CFR 1926.652(b)(2): Maximum allowable slopes, and allowable configurations for sloping and benching systems, were not determined in accordance with the conditions and requirements set forth in appendices A and B to this subpart. Miller Brothers Construction Inc., on or about September 11, 2019, at the address of 1628 East Wooster Road, Bowling Green, OH: The employer failed to ensure employees were adequately protected from cave-ins while repairing lines in a 7 foot deep trench. The single benching system that employees utilized on site during the inspection did not meet the requirements of Appendix B of Subpart P of this standard.
