29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems:  (a)MCS Contracting, LLC at 203 East Hwy 16, Oacoma, South Dakota 57365: On or about and at times prior to August 21, 2019, the employer did not ensure employees  engaged in roofing activities were protected from fall hazards. Employees were conducting re-roofing activities on a commercial project without the use of a fall protection system. This condition exposed employees to a fall hazard of approximately 20 feet.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  (a)MCS Contracting, LLC at 203 East Hwy 16, Oacoma, South Dakota 57365: On or about and at times prior to August 21, 2019, the employer did not ensure  the side rails of a portable extension ladder extended at least three feet above the roof. Employees were conducting re-roofing activities on a commercial project without the use of a fall protection system. This condition exposed employees to a fall hazard of approximately 20 feet.
