29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met (Construction Reference 1926.59):  a) At the construction site, a written hazard communication program had not been developed and implemented.  Contractors are exposed to hazardous substances such as, but not limited to, Mapei Ultrabond ECO 975, Crown Paint Thinner, Oatey Regular Clear Advance PVC Cement, and Weld-On Plumbing Primer for PVC, a corrosive, and welding fumes.

29 CFR 1910.1200(g)(8): The employer did not maintain in the workplace copies of the required safety data sheets for each hazardous chemical, and did not ensure that they were readily accessible during each work  shift to employees when they were in their work area(s) (Construction Reference 1926.59):  a) At the construction site, where safety data sheets (SDS) for hazardous substances such as, but not limited to, CADS water reinforced water based duct sealant, were not maintained.  b) At the construction site, where safety data sheets (SDS) for corrosive substances such as, but not limited to, Mapei Ultrabond ECO 975 and Crown Paint Thinner, were not maintained.  c) At the construction site, where safety data sheets (SDS) for painting chemicals were not maintained.  d) At the construction site, where safety data sheets (SDS) for welding alloy was not maintained.  e) At the construction site, a written hazard communication program had not been developed and implemented. For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1:  a) On or about October 4, 2019 at 2105F Engelmohr, where the employer did not implement the use of an integrated water delivery system while using a Makita handheld cut off saw to cut granite countertop, exposing employees to an inhalation hazard.  b) On or about October 4, 2019 at 2109B Engelmohr, where the employer did not implement the use of a dust collection system while using a Makita handheld cut off saw to cut exterior fiber-cement wall cladding, exposing employees to an inhalation hazard.
