29 CFR 1926.20(b)(1): A safety and health program was not initiated and maintained to provide compliance with the general safety and health provisions of the standard:    a) Eagle Roofing, Inc. at the address of 38259 Arbor Court in Grafton, Ohio; On or about September 18, 2019 the employer did not have a plan or program to identify job site hazards which assists employees in maintaining a safe working environment. Such programs would support the employer and employees in identifying and avoiding potential hazards such as, but not limited to, falls during jobsite operations.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:    a) Eagle Roofing, Inc. at the address of 38259 Arbor Court in Grafton, Ohio; On or about September 18, 2019 the employer did not ensure that employees had been adequately trained in the appropriate use of fall protection such as, but not limited to, the nature of fall hazards, the use of personal fall arrest systems, or alternative measures of fall protection. Employees were exposed to falls of approximately 18 ft. from the peak of the garage roof to the ground below during roof tear off operations of a 12:12 two story residential roof.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):     a) Eagle Roofing, Inc. at the address of 38259 Arbor Court in Grafton, Ohio; On or about September 18, 2019 the employer did not ensure employees were protected from fall hazards while tearing off roofing material of a residential home. Employees working in this manner were exposed to falls of approximately 18 ft. from the peak of the roof to the ground below.

29 CFR 1926.1053(b)(1): Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder:    a) Eagle Roofing, Inc. at the address of 38259 Arbor Court in Grafton, Ohio; On or about September 18, 2019 the employer did not ensure that the side rails of the extension ladder used to access the work area were extended at least three feet above the landing/working level. Employees utilizing the ladder in this condition were exposed to falls of approximately 18 feet while using the ladder to access and egress the working level.
