29 CFR 1926.20(b)(1): The employer did not initiate and maintain accident prevention programs as necessary to comply with this part:    (a)  Hammer One Construction located at 2750 Welsford Road Upper Arlington, OH 43221: On and preceding September 19, 2019, employees were framing in walls on a two story residential home at heights up to 19 feet without fall protection or other PPE. The employer did not initiate and maintain safety and health programs related to the roofing work being conducted by employees.

Framers were installing walls and other framing pieces on the second floor of a home that varied from 10-19 feet with the employees working at different levels. The employees were not utilizing proper eye, head or fall protection which exposed them to falls up to 19 feet and struck by hazards to the head and eyes.

Framers were installing walls and other framing pieces on the second floor and roof of a home that varied from 10-19 feet with the employees working at different levels. The employees were not utilizing head protection which exposed them to struck by hazards to the head.

29 CFR 1926.102(a)(1): Employees were not provided with eye and face protection equipment when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:    (a)  Hammer One Construction located at 2750 Welsford Road Upper Arlington, OH 43221: On and preceding September 19, 2019, the employer did not ensure employees wore safety glasses while utilizing power tools that presented struck-by hazards to the eyes and face. Framers were installing walls and other framing pieces using a pneumatic nail gun and a circular saw to cut the pieces. The employees were not utilizing eye protection which exposed them to struck by hazards to the eyes.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:    (a) Hammer One Construction located at 2750 Welsford Road Upper Arlington, OH 43221: On and preceding September 19, 2019, the employer did not ensure that the portable ladder used to gain access to the roof and exterior walls extended at least three feet beyond the eave that they were using for access.  The eave of the roof measured 8 feet above the floor of the second level. A six and eight foot stepladder were in provided by the owner and utilized by the framers for access to the upper surface. Framers were installing walls and other framing pieces on the second floor of a home that varied from 10-19 feet with the employees working at different levels. This condition exposed the framers to falls up to 19 feet.

29 CFR 1926.1053(b)(13): The top or top step of a stepladder was used as a step:    (a) Hammer One Construction located at 2750 Welsford Road Upper Arlington, OH 43221: On and preceding September 19, 2019, the employer did not ensure that the top step of the stepladder used for access to the upper level was not used.  Framers were accessing the upper level which was approximately 8 feet high using the top step of stepladders that were six and eight feet high. The framers were installing walls and other framing pieces on the second floor of a home that varied from 10-19 feet. This condition exposed the framers to falls up to 19 feet when standing on the top step on the second level near the edge at the front of the house.

Framers were installing walls and other framing pieces on the second floor of a home that varied from 10-19 feet with the employees working at different levels. The employees were not utilizing any form of fall protection which exposed them to falls up to 19 feet.
