Employees were exposed to approximately 35' falls. The roof was accessed at least monthly to conduct inspections, investigate equipment alarms and to perform preventive maintenance on rooftop mounted HVAC equipment.

29 CFR 1910.28(b)(13)(ii): (ii) When work is performed at least 6 feet (1.6 m) but less than 15 feet (4.6 m) from the roof edge, the employer did not ensure each employee is protected from falling by using a guardrail system, safety net system, travel restraint system, or personal fall arrest system:  Company: On or about September 19, 2019, the employer had not developed or implemented a fall protection program for use by employees when inspecting or servicing rooftop HVAC equipment.  Employees had not been provided with fall protection when inspecting and servicing rooftop mounted units located around the perimeter of the roof. Also, fall protection had not been provided when employees hoisted boxes of filters over the side of the roof that were to large to fit through the roof access hatch.   Abatement Note:  The work performed on the roof does not meet the criteria for being both infrequent and temporary.
