29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not made after every rainstorm or other hazard increasing occurrence: On or about September 19, 2019 the employer failed to ensure that inspections of excavations were performed prior to employees entering them to perform work. The worksite had a number of excavations present at the site during boring operations. One team was designated with the boring and a trailing team was designated to perform tie ins. Inspections of the excavation were not performed prior to either team entering the excavation. Differences between each excavation include but is not limited to water accumulation, depth, and soil type.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c); on or about September 19, 2019 the employer failed to ensure that adequate cave-in protection was in place to protect employees working in the excavation. Employees were working inside a trench measured at 5 feet 8 inches without any form of cave in protection in place.
