29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers. Note to paragraph (g)(1): The fall protection requirements for employees installing suspension scaffold support systems on floors, roofs, and other elevated surfaces are set forth in subpart M of this part.  a. On or about September 20, 2019, located at the DTD House at 219 Fourth Street in Marietta, Ohio, employees were performing roofing work from roof bracket scaffolding without being protected from falls, thereby exposing the employees to a fall hazard of approximately 25 feet.

29 CFR 1926.451(e)(1): When scaffold platforms are more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface shall be used. Crossbraces shall not be used as a means of access.  a. On or about September 20, 2019, located at the DTD House at 219 Fourth Street in Marietta, Ohio, employees did not have a safe means of access when climbing onto roof bracket scaffolds while not being protected from falls, thereby exposing the employees to a fall hazard of approximately 25 feet.  b. On or about September 20, 2019, located at the DTD House at 219 Fourth Street in Marietta, Ohio, an employee was not protected from falls when climbing from a roof bracket scaffold plank to a single roof bracket, thereby exposing the employee to a fall hazard of approximately 25 feet.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.  a. On or about September 20, 2019, located at 219 Fourth Street in Marietta, Ohio, employees were installing shingles on a steep-pitched roof without being protected from falls, thereby exposing the employees to a fall hazard of approximately 25 feet.
