29 CFR 1926.760(a)(1): Each employee engaged in a steel erection activity who is on a walking/working surface with an unprotected side or edge more than 15 feet (4.6 m) above a lower level was not protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems, or fall restraint systems. (a) Operator Indoor Training Facility: On or about February 3, 2023, and times prior, employees were installing the metal roof panels and insulation on a new pre-engineered metal building with a 3/12 pitched roof and were not protected from fall hazards of 20ft. up to approximately 42ft. above grade.

29 CFR 1926.761(b): The employer did not train each employee exposed to a fall hazard in accordance with the requirements of this section. The employer shall institute a training program and ensure employee participation in the program. (a) 3377 Medina Road, Ravenswood WV: On or about February 3, 2023, and time prior, employees were installing insulation and metal roofing on a pre-engineered metal building. Employees trained in construction industry fall protection rules and regulations were unable to recognize the hazard and required further training in the Subpart R fall protection requirements.

29 CFR 1904.7(b)(3): The employer did not correctly classify the following work-related injuries or illnesses on the OSHA Form 300 or equivalent. (a) Operator Indoor Training Facility: On or about February 15, 2023, and times prior, the employer did not classify an injury resulting in days away from work correctly on the Log of Work-Related Injuries and Illnesses/OSHA Form 300. On February 3, 2023, an employee was working on a roof and fell 30ft. to the ground below resulting in severe injuries causing days away from work, column (H) -Days away from work and column (K)-Away from workdays were left blank on the OSHA Form 300 log.
