29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, were not provided:  At the jobsite, employees were mixing and applying Parex Stucco which contained Crystalline silica (10 mg/cubic meter), Portland cement (5 mg/cubic meter), and Calcium hydroxide (5 mg/cubic meter), without the use of protective equipment to protect eyes, face, and extremities, protective clothing and respiratory devices from inhalation and skin burns.

29 CFR 1926.451(b)(1)(i): Each platform unit (e.g., scaffold plank, fabricated plank, fabricated deck, or fabricated platform) was not installed so that the space between adjacent units and the space between the platform and the uprights were no more than 1 inch (2.5 cm) wide, except where the employer can demonstrate that a wider space is necessary:  At the job site, where employees worked from a supported scaffold to perform masonry activities which had excessive spacing between planks of greater than 1-inch.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.  Cross braces were used as a means of access:   At the jobsite, employees on a supported scaffold were using the crossbraces of the scaffold as a means of access from the scaffold platforms.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section:  At the jobsite, employees installing Parex stucco on the roof gable of a residential structure while on a scaffold were exposed to a 12-ft. 8-inch (386.08 cm) foot fall without fall protection.

29 CFR 1926.451(g)(4)(i): Guardrail systems were not installed along all open sides and ends of platforms before being released for use by employees other than erection/dismantling crews:   At the job site, employees were observed installing Parex stucco from the top planking of the supported scaffold without guardrails on the open side and ends which exposed them to greater than 10 feet fall hazards to the unfinished ground below.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area: (Construction Reference: 1926.59)  At the job site, the employer did not ensure that employees exposed to the hazards of Crystalline silica (10 mg/cubic meter), Portland cement (5 mg/cubic meter), and Calcium hydroxide (5 mg/cubic meter), while applying Parex stucco were provided effective information and training on hazardous chemicals in their work area at the time of their initial training. This condition exposed employee(s) to dermal and inhalation hazards.
