29 CFR 1926.100(a): Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns:  (a) In and around the structure - On or about April 24, 2019 and at times prior to, the employer did not ensure that hard hats were worn by employees who were exposed to a struck-by hazard while passing lumber between the 1st and 2nd floor of a building.  Casimiro Santiago Vicente was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.100(a), which was contained in OSHA Inspection Number 1221012 Citation Number 1, Item Number 1 and was affirmed as a final order on May 1, 2017 with respect to a workplace located at 110 Red Oak Lane Lot #6 Rincon, GA 31326.

29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  (a) Roof frame - On or about September 26, 2019 and at times prior to, the employer did not provide safety glasses for employees who were exposed to a flying object hazard while framing a building using nail guns without wearing eye protection.  Casimiro Santiago Vicente was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.102(a)(1) which was contained in OSHA Inspection Number 1221012 Citation Number 1, Item Number 2 and was affirmed as a final order on May 1, 2017 with respect to a workplace located at 110 Red Oak Lane Lot #6 Rincon, GA 31326.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:  (a) Roof frame - On or about September 26, 2019 and at times prior to, the employer did not ensure that fall protection was utilized for employees who were framing a building on the rafters 14 feet above a concrete floor with no fall protection.  Casimiro Santiago Vicente was previously cited for a violation of an equivalent occupational safety and health standard 29 CFR 1926.501(b)(13) which was contained in OSHA Inspection Number 1221012 Citation Number 1, Item Number 3A and was affirmed as a final order on May 1, 2017 with respect to a workplace located at 110 Red Oak Lane Lot #6 Rincon, GA 31326.

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:   (a) Throughout the construction site - On or about September 26, 2019 and at times prior to, the employer did not train each employee exposed to various hazards associated with construction on how to recognize and minimize these hazards for activities such as nail gun use, handling lumber, and working on elevated surfaces.
