29 CFR 1910.119(e)(5): The employer did not establish a system to promptly address PHA team findings and recommendations; assure that the recommendations were resolved in a timely manner with documented resolutions; document the actions that were to be taken; complete actions in a timely manner; develop a written schedule of action completion dates; and communicate the actions to employees working in the process areas or who may be affected by the recommendations or actions: a) On or around October 2, 2019 and at times prior thereto at the Kuraray America Inc. La Porte Plant, the employer exposed workers in its Control Room to inhalation hazards from toxic fumes when it did not address the findings of the facility siting evaluation that revealed the air infiltration rate of 1.72 ACH in the Shelter-In-Place location at the Control Room exceeded the acceptable limit of 0.75 ACH that is defined in the employer's Site Safety Manual. b) On or around October 2, 2019 and at times prior thereto at the Kuraray America Inc. La Porte Plant, the employer exposed workers to inhalation hazards from toxic fumes when it allowed the Administration Building Shelter-In-Place Location to have an air infiltration rate of 1.75 ACH, exceeding the employer's acceptable limit of 0.75 ACH which is defined in the Site Safety Manual / Emergency Action Plan.
