29 CFR 1926.453(b)(2)(v): A body belt with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift: (a) New Townhome Construction located at Building #5, East side of end unit: On or about 10/01/2019, and at times prior, the employer exposed employees to ejection/fall hazards of more than 13-feet to the lower level, in that a complete fall arrest system was not used while traveling inside the Aerial Lift Basket from the ground level to the roof. Painters In Action, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.453(b)(2)(v), which was contained in OSHA inspection number 1376399, citation number 1, item number 2(b) and was affirmed as a final order on 05/02/2019, with respect to a workplace located at 1450 Newnan Crossing Blvd., Newnan, GA 39265.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: (a) New Townhome Construction located at Building #5, East side of end unit lower roof: On or about 10/01/2019, and at times prior, the employer exposed employees to fall hazards of 10-feet, 1-inch to the lower level, in that a fall protection system was not used while engaged in painting activities on the lower 4/12 pitched roof. Painters In Action, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1376399, citation number 1, item number 2(a) and was affirmed as a final order on 05/02/2019, with respect to a workplace located at 1450 Newnan Crossing Blvd., Newnan, GA 39265.
