29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c). On or about October 2, 2019, at a job-site located at 3322 Clarkmill Rd, Norton, Ohio 44203; the employer did not ensure that an employee worked at all times inside the existing protective system in place in an approximately 14 feet deep trench. An employee was injured by a shifting road plate when he stepped outside the existing protective system inside a trench with near vertical side walls, type "C" soil and a depth of approximately 14 feet."

29 CFR 1926.652(g)(1)(ii): Shields were not installed in a manner to restrict lateral or other hazardous movement of the shield in the event of the application of sudden lateral loads: On or about October 2, 2019, at a job-site located at 3322 Clarkmill Rd, Norton, Ohio 44203; the employer did not ensure multiple road plates "Shields" were installed properly alongside an installed trench box to restrict lateral movement which caused serious injury to an employee that was caught underneath a shifted road plate while working in a trench with varying depths of 16 to 18 feet and determined to have type "C" soil.

29 CFR 1926.652(g)(1)(iii): Employees were not protected from the hazard of cave-ins when entering or exiting the area protected by shields: On or about October 2, 2019, at a job-site located at 3322 Clarkmill Rd, Norton, Ohio 44203; the employer did not ensure adequate cave-in protection was used to protect an employee at the point of access and or egress (east side of trench between the manhole and trench box). The trench had near vertical side walls and a depth varying from approximately 16 to 18 feet. The trench was determined to have type "C" soil, and the trench had seeping and standing water on the trench floor.
