OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees who were transferring combustible dust from super sacks into tank truck trailers: A) Front of the warehouse, on or about October 9, 2019 and or time prior to, employees transferred Pentaerythritol powder from a super sack to the inside of a tank truck trailer, which created a combustible dust and static electricity, exposing employees to a flash fire and or explosion.

29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval: A) Warehouse, on or about October 9, 2019, and or times prior to, the employees used a special attachment that hung on the forklift carriage without written permission from the manufacture, or having an engineer approve the attachment, to lift super sacks, exposing the employees to struck-by hazards.
