On or about October 2, 2019, for the worksite at 619 Ludham Trail NW, Pickerington, Ohio, the employer failed to ensure that eye protection was used when employees were exposed to hazards from flying particles, such as during pneumatic nail gun use. Due to this lack of eye protection, an employee who was installing roof trusses and roof structural members on the front entry door roof was exposed to increased risk for eye injury

29 CFR 1926.1053(b): Use. The following requirements apply to the use of all ladders, including job-made ladders, except as otherwise indicated:   29 CFR 1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support.  a. On or about October 2, 2019 for the worksite at 619 Ludham Trail NW, Pickerington, Ohio, a ladder did not extend three feet above the landing surface of the job made work platform in the front entry porch area. The ladder extended only 6 inches above the landing surface. Due to this condition, employees were exposed to increased risk for fall during use of the ladder to access and egress from the job made work platform.

The following requirements apply to the use of all ladders, including job-made ladders, except as otherwise indicated:   29 CFR 1926.1053(b)(4): Ladders shall be used only for the purpose for which they were designed.  a. On or about October 2, 2019 for the worksite at 619 Ludham Trail NW, Pickerington, Ohio, an A-frame ladder was used in a manner other than the design. The ladder was used in the closed position; in that the legs were not opened to assure the rails were completely spread, with the spreader bar locked in position and the ladder feet securely in position. Due to this condition, employees were exposed to increased risk for fall during use of the ladder to access and egress from the job made work platform.

The program shall enable each employee to recognize hazards related to ladders and stairways, and shall train each employee in the procedures to be followed to minimize these hazards.  a. On or about October 2, 2019 for the worksite at 619 Ludham Trail NW, Pickerington, Ohio, the employer failed to provide training for two employees who used a ladder for framing carpentry work in the front entry porch area. The ladder was used inappropriately and did not extend three feet above the landing surface of a job made work platform. Due to these conditions, employees were exposed to fall hazards during use of the A-frame ladder.

Employees performing framing carpentry were exposed to hazards associated with ladder use, failure to provide fall protection and pneumatic nail gun use due to the failure to initiate and maintain programs compliant with this part.  Yaher Construction LLC was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1340680, citation number 1, item number 1  and was affirmed as a final order on September 28, 2018 with respect to a workplace located at 7309 Willowbrush Drive, Plain City, Ohio 43064.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.  a. On or about October 2, 2019, for the worksite at 619 Ludham Trail NW, Pickerington, Ohio, the employer failed to provide fall protection and employees were not protected from falling while performing framing carpentry work on a single family residential home. A guardrail system, safety net system or personal fall arrest system was not utilized. Due to this condition, employees were exposed to fall hazards of approximately twelve feet when performing framing installation and roof truss assembly for the roof surface at the front entry.   Yaher Construction LLC was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1340680, citation number 2, item number 1 and was affirmed as a final order on September 28, 2018, with respect to a workplace located at 7309 Willowbrush Drive, Plain City, Ohio 43064.  Yaher Construction LLC was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1257088, citation number 1, item number 1 and was affirmed as a final order on September 20, 2017, with respect to a workplace located at 723 Bretforton Street NW, Pickerington, Ohio 43147.  Yaher Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard (29 CFR 1926.501(b)(11)), which was contained in OSHA inspection number 1011485, citation number 2, item number 1 and was affirmed as a final order on March 4, 2015, with respect to a workplace located at 471 North Hamilton Road, Gahanna, Ohio 43230.
