29 CFR 1926.451(f)(7): Scaffolds were not erected, moved, dismantled, or altered, by trained and experienced employees under the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling or alteration. Such activities were not performed only by experienced and trained employees selected for such work by the competent person. a) MK1 Construction, LLC, 1336 Hecla Drive, Louisville, CO 80027: On and before October 18, 2019, the employer did not ensure that a job-made platform attached to the Skyjack SJ1256 THS Telehandler was erected and installed under the supervision and direction of a competent person qualified in scaffold erection or alteration. An employee used the platform attached to the Skyjack Telehandler as a scaffold, working inside the platform when the platform was elevated higher than the roof. The platform was connected to the Telehandler forks via nylon rigging, and there was no assurance that the platform was securely connected to the Telehandler forks. This condition exposed employees to fall hazards.

29 CFR 1926.451(g)(1)(vii): For all scaffolds not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of 1926.451(g), each employee was not protected by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4): a) MK1 Construction, LLC, 1336 Hecla Drive, Louisville, CO 80027: On and before October 18, 2019, the employer did not ensure that for all job-made scaffolds not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of 1926.451(g), each employee was protected by the use of personal fall arrest systems or guardrail systems. An employee was working inside a job-made platform attached to the Skyjack SJ1256 THS Telehandler. The platform was elevated higher than the building's roof. An employee was working inside the platform without fall protection, in that he was not wearing a personal fall arrest system, and no guardrails had been installed and used. This condition exposed this employee to a fall hazard of approximately 30 feet.

Employees were shingling without the use of fall protection. This condition exposed six employees to fall hazards of approximately 30 feet.
