29 CFR  1926.20(b)(2):The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person:  (a) On or about October 3, 2024, and at times prior, MK1 Construction, LLC as a controlling employer, did not ensure a safety program was developed and implemented for the work environment, to include effective frequent and regular inspections made by a competent person of the job-site, materials, and equipment.  Employees of Miguel Angel Cepeda were conducting residential roofing activities  near the edge of the building without utilizing a fall protection system. This condition exposed the employees to a fall hazard of approximately 10 feet to the ground below.

29 CFR  1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a) On or about October 3rd, 2024, and at times, prior,  MK1 Construction, LLC as a controlling employer, did not ensure that subcontractor employees were  protected from struck-by hazards from using a pneumatic air nail gun to secure sheathing to a residential roof without the benefit of eye protection.

29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a) On or about October 3, 2024, and at times prior, MK1 Construction, LLC as a controlling employer, did not ensure that subcontractor employees  were protected from fall hazards of approximately 10 feet to the ground below while conducing re-roofing operations without any means of fall protection.  MK1 Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1438739, citation number 1, item number 2c, and was affirmed as a final order on February 6, 2020, with respect to a workplace located at 1336 Hecla Drive, Louisville, CO 80027.
