THE LARRY MCWATERS & ASSOCIATES, LLC WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29 CFR 1926.501(B)(11) WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 1374262, CITATION NUMBER 1, ITEM NUMBER 1, AND WAS AFFIRMED AS A FINAL ORDER ON APRIL 9, 2019, WITH RESPECT TO A WORKPLACE LOCATED AT 23092 PERDIDO BEACH BLVD., HILTON GARDEN INN, ORANGE BEACH, ALABAMA AND IN OSHA INSPECTION NUMBER 1118027, CITATION NUMBER 1, ITEM NUMBER 2, AND WAS AFFIRMED AS A FINAL ORDER ON MARCH 28, 2016, WITH RESPECT TO A WORKPLACE LOCATED AT 909 ARIOLA DRIVE, PENSACOLA BEACH, FLORIDA AND IN OSHA INSPECTION NUMBER 1398808, CITATION NUMBER 2, ITEM NUMBER 1, AND WAS AFFIRMED AS A FINAL ORDER ON AUGUST 22, 2019, WITH RESPECT TO A WORKPLACE LOCATED AT 2299 WEST BEACH BOULEVARD, GULF SORES, ALABAMA.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:    a)  At 2277 West Beach Blvd., Gulf Shores, Alabama:  On or about October 21, 2019 and at times prior; the employer allowed his employees to use an extension ladder set up on the deck to gain access to the roof and the ladder rails did not extend three feet above the roof landing to provide safe access exposing his employees to a fall hazard of 10 feet to the deck below.  b)  At 2277 West Beach Blvd., Gulf Shores, Alabama:  On or about October 21, 2019 and at times prior; the employer allowed his employees to use an extension ladder set up on the ground level to gain access to the second floor deck and the ladder rails did not extend three feet above the landing to provide safe access exposing his employees to a fall hazard of 24 feet  7 inches to the ground below.  THE LARRY MCWATERS & ASSOCIATES, LLC WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29 CFR 1926.1053(B)(1) WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 1398808, CITATION NUMBER 1, ITEM NUMBER 1, AND WAS AFFIRMED AS A FINAL ORDER ON AUGUST 22, 2019, WITH RESPECT TO A WORKPLACE LOCATED AT 2299 WEST BEACH BOULEVARD, ORANGE BEACH, ALABAMA.
