29 CFR 1910.178(l)(1)(i): The employer had not ensured that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in paragraph (l) [Reference 29 CFR 1926.602(d) for construction:  Employees were exposed to struck by, crushing, and fall hazards.  Employee(s) engaged in framing the outside of the building located at 12174 S. Quail Ridge Drive, Olathe, Kansas were exposed to struck by, crushing, and fall hazards. Employees were not instructed in the recognition of hazards associated with working from a powered industrial vehicle.

The employee was standing on a platform that was attached to an all terrain forklift as the employee framed the south side of residential building under construction.
