29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them): JOB SITE: 2005 St Andrews Drive, Saint Charles, MO 63301, on or about 10/29/2019, the employer failed to conduct frequent and regular inspections of the job site by a competent person who is capable of identifying existing and predictable hazards on the job site. The employer allowed his employees to be exposed to fall and struck-by hazards: 1. Employees were permitted to work from a ladder jack scaffold, approximately 12 feet above ground level without Personal Fall Arrest System (PFAS). 2. Employees were permitted to work underneath overhead hazards of falling debris without protective helmets (hard hats). 3. Employees were permitted to operate pneumatic nail guns without eye or face protection.
