29 CFR 1910.28(b)(1)(i)(A): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level was protected from falling by a standard guardrail system: Guardrail systems, safety net systems, or personal fall arrest systems.     Employees were exposed to falls from heights of 4 feet or more as follows:     On or about October 29, 2019, an employee was elevated on the forks and pallet of a powered industrial truck to access products on high reach shelves. Employees were exposed to falls between 10 and 14 feet to the ground below.     Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).

29 CFR 1910.178(l)(2)(ii): Training shall consist of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.    On or about October 29, 2019, the employer allowed employees to operate forklifts without ensuring that each powered industrial truck operator had successfully completed training consisting of a combination of formal instruction through computer based training, videos, written exercises, etc. and an evaluation of operating performance (driving test) in the workplace. Employees were exposed to struck-by injuries.       Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d)

29 CFR 1910.178(p)(1): If at any time a powered industrial truck is found to be in need of repair, defective, or in any way unsafe, the truck shall be taken out of service until it has been restored to safe operating condition.    On or about October 29, 2019, the employer failed to a remove a Yale powered industrial truck in need of repair when employees were required to operate the forklift without proper functioning visual or audio devices. There was no proper functioning flashing, rotating or strobe lights and no back-up alarms when driving in reverse. Employees were exposed to struck-by injuries when operating the forklift.    Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d)

29 CFR 1910.212(a)(1): Types of guarding. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices, electronic safety devices, etc.    On or about October 29, 2019, the employer failed to provide adequate guarding to protect employees from gaining access to moving rollers and elevator assembly while operating the Econo-Stretch 100 shrinkwrap machine. Employees were exposed to amputation and crushing hazards while standing on the platform and operating the shrinkwrap machine.     Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d)

29 CFR 1910.305(g)(1)(iv)(A): Flexible cords may not be used as a substitute for the fixed wiring of a structure;  On or about October 29, 2019, flexible cords were used as a substitute for fixed wiring on the Econo-Stretch 1000 shrinkwrap machine in the warehouse. 29 CFR 1910.305(g)(1)(iv)(D): Unless specifically permitted otherwise in paragraph (g)(1)(ii) of this section, flexible cords and cables may not be used: Where attached to building surfaces.  On or about October 29, 2019, flexible cords powering a shrinkwrap machine, liquid level alarm sensor and a submersible pump were attached to a metal conduit and a PVC drain pipe.  This could cause damage to the outer jacket of the cord.   Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).
