29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (Construction Reference: 1926.59)    On or about October 31, 2019, at 7102 Gulf of Mexico Blvd., in Marathon, FL, the employer did not develop and implement a written hazard communication program for employees performing concrete chipping, formwork and stucco operations, and who were required to work with hazardous chemicals including, but not limited to, Portland Cement a corrosive (with a pH of 12-13).

29 CFR 1926.52(d)(1): In all cases where the sound levels exceeded the values shown in Table D-2 of 29 CFR 1926.52, a continuing, effective hearing conservation program was not administered:    On December 18, 2019, at a worksite located at 7102 Gulf of Mexico Blvd., in Marathon, FL, the employer did not administer an effective hearing conservation program, inclusive of noise monitoring, engineering/administrative controls, training, baseline and annual audiograms, for employees who were exposed to sound levels that exceeded the values shown in Table D-2 of 29 CFR 1926.52, such as, but not limited to an employee while performing jackhammering on concrete was exposed to an 8-hour Time Weighted Average noise exposure dose of 148.5%, or 92.8 dBA, with a sampling time of 377 minutes.

29 CFR 1926.95(a): Personal protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, or maintained in a sanitary and reliable condition it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation, or physical contact.    a) On or about October 31, 2019, at 7102 Gulf of Mexico Blvd., in Marathon, FL, the employer did not ensure who were employees performing stucco application using a hazardous chemical such as, but not limited to Portland Cement a corrosive (with a pH of 12-13), used appropriate hand protection.    b) On or about October 31, 2019, at 7102 Gulf of Mexico Blvd., in Marathon, FL, the employer did not ensure that employees performing concrete chipping and formwork operations, maintained their hand protection without defects and/or hard hat in a sanitary and/or reliable condition.
