29 CFR 1910.134(c)(2)(ii): In addition, the employer must establish and implement those elements of a written respiratory protection program necessary to ensure that any employee using a respirator voluntarily is medically able to use that respirator, and that the respirator is cleaned, stored, and maintained so that its use does not present a health hazard to the user. Exception: Employers are not required to include in a written respiratory protection program those employees whose only use of respirators involves the voluntary use of filtering facepieces (dust masks): a) On or about November 25, 2019, Welders voluntarily wearing half mask cartridge respirators were not medically evaluated to determine if using respiratory protection was medically advisable. b) On or about November 25, 2019; two half mask cartridge respirators were stored by hanging the respirators with the welding helmets in the facility. Hanging the respirators in the shop area does not prevent material collecting on the interior surface of the half mask cartridge respirators.

29 CFR 1910.1026(d)(1): General. Each employer who has a workplace or work operation covered by this section shall determine the 8-hour TWA exposure for each employee exposed to chromium (VI). This determination shall be made in accordance with either paragraph (d)(2) or paragraph (d)(3) of this section: a) On or about November 25, 2019, the employer had not conducted initial employee monitoring to determine the chromium (VI) exposure to Welders while welding stainless steel.
