29 CFR 1910.178(l)(4)(iii): An evaluation of each powered industrial truck operator's performance shall be conducted at least once every three years.    During the month of November 2019 and thereafter, the employer did not re-evaluate each authorized forklift operator at least once every three years to ensure they had the skills and knowledge necessary to operate safely.

29 CFR 1910.178(l)(6): Certification. The employer shall certify that each operator has been trained and evaluated as required by this paragraph (l). The certification shall include the name of the operator, the date of the training, the date of the evaluation, and the identity of the person(s) performing the training or evaluation.  During the month of November 2019 and thereafter, the employer did not certify that each operator, who had previously received training and that such training was appropriate to the truck and working conditions encountered, were evaluated and found competent to operate the forklift safely.

29 CFR 1910.254(d)(9)(iii): Cables with damaged insulation or exposed bare conductors shall be replaced. Joining lengths of work and electrode cables shall be done by the use of connecting means specifically intended for the purpose. The connecting means shall have insulation adequate for the service conditions.     During the month of November 2019 and thereafter, the Hypertherm Powermax 85 had a damaged cable exposing employees to electrical shock hazards.

29 CFR 1910.334(a)(2)(ii): If there is a defect or evidence of damage that might expose an employee to injury, the defective or damaged item shall be removed from service, and no employee may use it until repairs and tests necessary to render the equipment safe have been made.    (a)  During the month of November 2019 and thereafter, the electrical power cord used with the Miller Millermatic 350P welders had a missing grounding prong and had electrical tape around the plug and was not removed from service exposing employees to electrical shock hazards.    (b)  During the month of November 2019 and thereafter, the electrical power cord used with the Miller Millermatic 252 welders had a missing grounding prong and had electrical tape around the plug and was not removed from service exposing employees to electrical shock hazards.    (c)  During the month of November 2019 and thereafter, the Ellis horizontal bandsaw had a missing grounding prong and was not removed from service exposing employees to electrical shock hazards.
