29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, or other hazardous conditions. An inspection was not conducted by the competent person prior to the start of work and as needed throughout the shift. Inspection were not made after other hazard increasing occurrence. These inspections are only required when employee exposure can be reasonably anticipated: Employees were exposed to cave-in hazards. On or about October 23, 2019, employees engaged in sewer line installation activities, inside of a trench greater than 12 feet in depth, were exposed to cave-in hazards in that daily inspections of the trench site were not conducted.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c). Employees were exposed to cave-in hazards. On or about October 23, 2019, employees engaged in sewer line installation activities, inside of a trench greater than 12 feet in feet in depth, were exposed to cave-in hazards in that an adequate protective system was not provided. The height of the trench box was approximately 7 feet, 8 inches.
