29 CFR 1910.178(l)(2)(ii): is applicable to construction employment as referenced by 1926.602(d): The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace:    The employer is failing to protect employees from a struck by hazard when operating an all terrain forklift, powered industrial truck, at a residential construction site. This was most recently documented on or about November 5, 2019 at 3527 Blue Holly Drive, Lincoln, NE 68504. Operator of the powered industrial truck had not successfully completed the training required by paragraph (l) of the standard. An evaluation of each powered industrial truck operator's performance was not being conducted at least once every three years.

This was most recently documented on or about November 5, 2019 at a residential construction jobsite located at 3527 Blue Holly Drive, Lincoln, NE 68504 where the employer has employees operating pneumatic nail guns while framing.

This was most recently documented on or about November 5, 2019 at 3527 Blue Holly Drive, Lincoln, NE 68504 when employees were observed installing trusses on a residential structure while working at greater than 6 feet above the ground without fall protection.

This was most recently documented on or about November 5, 2019 at  3527 Blue Holly Drive, Lincoln, NE 68504. The top level of a 6-foot step ladder was used by employees to access the upper landing surface.
