29 CFR 1926.28(a): The employer did not require the wearing of appropriate personal protective equipment in all operations where there is an exposure to hazardous conditions:      a) On or about November 6, 2019, employees were not provided with appropriate foot protection to guard against punctures and lacerations to the feet when required to work on and in roofing debris containing nails.   b) On or about November 6, 2019, subcontractor employees were not provided with appropriate foot protection to guard against punctures and lacerations to the feet when required to work on and in roofing debris containing nails.      In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:           a) On or about November 6, 2019, employees were exposed to the hazard of falling approximately 16 feet where a portable extension ladder used to access the roof elevation of the building did not extend above the landing surface.  b) On or about November 6, 2019, subcontractor employees were exposed to the hazard of falling approximately 16 feet where a portable extension ladder used to access the roof elevation of the building did not extend above the landing surface.           No abatement certification or documentation required for this violation.

29 CFR 1926.1053(b)(22): Employees using ladders were carrying objects or loads that could cause the employee to lose balance and fall:            a) On or about November 6, 2019, employees were exposed to the hazard of falling from elevations up to approximately 16 feet when required to climb portable ladders while carrying materials and equipment to a roof deck landing surface.     In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b):        a) On or about November 6, 2019, employees were exposed to the hazard of falling while working without fall protection from pitched roof surfaces having ground to eave heights ranging from approximately 8 to 16 feet.   b) On or about November 6, 2019, subcontractor employees were exposed to the hazard of falling while working without fall protection from pitched roof surfaces having ground to eave heights ranging from approximately 8 to 16 feet.    Rene Construction Corp. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13) which was contained in OSHA inspection number 1250969, citation 2, item 1, and was affirmed as a final order on October 25, 2017, with respect to a worksite located at 554 W. Rosiland Drive, Palatine, Illinois.       No abatement certification or documentation required for this violation.
