OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to crushed-by and/or struck-by hazards. On or about November 13, 2019, the employer did not ensure employees were protected from under-ride hazards associated with the operating standup forklifts. A Raymond Reach Truck (Forklift, Model 750-R35TT S/N 750-15-BC49196) was not equipped with rear post guards, or other feature to prevent an under-ride from occurring nor did the employer adjust the shelf heights so that the overhead guard or bottom of the forklift would strike the rack in the event of contact.

29 CFR 1910.178(l)(3)(i)(M): Any other operating instructions, warnings, or precautions listed in the operator's manual for the types of vehicle that the employee is being trained to operate. On or about November 13, 2019 the employer did not ensure that the forklift training provided to its employees included other operating instructions, warning, or precautions listed in the operator's manual for the types of forklifts that the employees were being trained to operate. This condition exposed employees to struck-by and crushed-by hazards.
