29 CFR 1926.501(b)(13): Employees performing roofing work are not protected from fall hazards the use of a fall protection system: a) The employer fails to ensure effective protection against falls as required by the standard, as demonstrated on or about November 14, 2019, at 9271 Crescent Lodge Circle, Lot 6 Woodland Creek, Pike Road, Alabama, when employees performing roofing activities from a high slope roof, without the use of conventional fall protection, were exposed to a fall hazard of up to 10 feet 7 inches to the ground below. To abate this violation, the employer must ensure that all employees wear appropriate fall protection or install safety net system when an employee works 6 feet or more above a lower level.

THE OSCAR GARDUNO RUBIO DBA OSCAR GARDUNO RUBIO WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29 CFR 1926.1053(B)(1), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 1165744 CITATION NUMBER 1, ITEM NUMBER 2, AND WAS AFFIRMED AS A FINAL ORDER ON AUGUST 16, 2016, WITH RESPECT TO A WORKPLACE LOCATED AT 7955 OAKCREST PLACE, THE OAKS, MONTGOMERY, ALABAMA AND IN OSHA INSPECTION NUMBER 1183161 CITATION NUMBER 2, ITEM NUMBER 2, AND WAS AFFIRMED AS A FINAL ORDER ON FEBRUARY 15, 2017, WITH RESPECT TO A WORKPLACE LOCATED AT 7943 OAK CREST PLACE, THE OAKS, MONTGOMERY, ALABAMA.
