OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were potentially exposed to an oxygen deficient or toxic atmosphere associated with carbon dioxide: a. On or about November 14, 2019, in the Individual Quick Freeze room, employees were not adequately protected against the release of carbon dioxide and a toxic atmosphere in that: the process room where employees operated the Individual Quick Freeze that used carbon dioxide was not provided with a gas detection and alarm system to warn employees of a release of carbon dioxide in hazardous concentrations.
